1. Acceptance of Terms

By downloading, installing, or using the Color Palette mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Color Palette is a mobile application that allows users to:

• Extract colors from photos and images
• Create and save color palettes
• Match colors to various brand standards (Pantone, Benjamin Moore, etc.)
• Generate color harmonies and combinations
• Overlay palettes on images
• Export colors in various formats (RGB, HSL, CMYK, Hex)

3. App Features and Premium Upgrade

3.1 Free Features

Color Palette provides all features free of charge, including:

• Unlimited color extractions from photos
• Unlimited palette and swatch creation
• Access to all color brand databases
• Palette overlay functionality
• Advanced export options
• Color harmony previews
• All premium features are included for free

3.2 Premium Upgrade

Premium is available as a one-time purchase:

• One-Time Purchase: $6.99
• No Subscriptions: Own it forever, no recurring charges

3.3 Premium Benefits

The premium upgrade provides:

• Removal of all advertisements (banner, interstitial, and rewarded ads)
• Ad-free experience
• Support for continued app development

Note: All app features are available to free users. Premium only removes advertisements.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer or modify the App
• Not use the App to infringe on intellectual property rights
• Maintain the security of your device and account
• Not share your premium subscription with others

5. Intellectual Property

The App and its content, including but not limited to text, graphics, images, and software, are owned by the developer and are protected by copyright and other intellectual property laws.

You retain ownership of any content you create using the App, but you grant us a license to use such content for the purpose of providing and improving the service.

6. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference. The App may collect and process certain data to provide services and improve functionality.

Data collected may include:

• App usage statistics
• Device information
• User-generated content (palettes, swatches)
• Subscription and payment information

7. Premium Purchase and Billing

7.1 One-Time Purchase

Premium is available as a one-time, non-consumable in-app purchase through the App Store. Payment will be charged to your Apple ID account at confirmation of purchase.

7.2 No Recurring Charges

Premium is a one-time purchase with no recurring charges, no auto-renewal, and no subscription fees. Once purchased, you own it forever.

7.3 Restore Purchases

You can restore your premium purchase on any device using the same Apple ID. Use the "Restore Purchases" feature in the app to restore your premium status.

7.4 Refunds

Refund requests for in-app purchases must be made through Apple's refund process. Contact Apple Support for assistance with refunds.

8. Disclaimers and Limitations

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted.

Color matching results are provided for reference only and may not be 100% accurate. Always verify colors for critical applications.

In no event shall we be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice.

Upon termination, your right to use the App will cease immediately, and you may lose access to your data and premium features.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email.

Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer operates, without regard to conflict of law principles.
